VIOLATIONS OF THE TERMS AND CONDITIONS

Communications, suggestions, comments and complaints may be sent via first class mail. Taco Bell may, but typically will not, acknowledge receipt of the e-mail or other communication.

PLEASE BE AWARE THAT BY SENDING TACO BELL ANY INFORMATION, WHETHER VIA AND E-MAIL OR U.S. MAIL the Users hereby grants to Taco Bell a worldwide, perpetual, irrevocable, royalty-free, sublicenseable right, in any media now known or not currently known, to exercise all copyright rights with respect to the content you provide to us to be published on the Site through our data entry forms, including, but not limited to, the right to reproduce, display, distribute, publicly perform, distribute, communicate and make derivative works. The foregoing does not apply to any content contained on hyper-linked pages or any other content Users do not submit to Taco Bell. Users expressly waive any property rights, including any intellectual property rights in whole or in part in such communications, content, or materials.

HOW TO REPORT A VIOLATION OR PROBLEM

If you believe that any material, transmission, posting, or communication to the Site, or within the Site violates the Terms and Conditions, or wish to communicate any problems please observe the following procedures. If you believe that the violation or problem concerns proprietary rights, such as trademark, copyright, invasions of privacy, right of publicity, or trade secrets, the e-mail should include the information listed under the heading "Proprietary Rights Complaint."

Taco Bell will not necessarily acknowledge the receipt of e-mails.

Once a proper complaint or violation e-mail is received and a preliminary investigation undertaken, Taco Bell may, at its sole discretion, (1) temporarily or permanently remove, modify, or delete the material or communication from the Site; (2) conduct further investigation; (3) attempt to contact the User who posted, transmitted, submitted, or otherwise communicated the allegedly offending material or communication to the Site; (4) temporarily or permanently deny access to the material or communication; or (5) otherwise try to correct or amend the problem.

Taco Bell may, at it sole discretion, allow the User who posted, transmitted or communicated the material to respond to the complaint.

If the User who posted, transmitted, or otherwise communicated the material to the Site does not want it removed, deleted, or modified, at Taco Bell's sole discretion Taco Bell may leave the materials on the Site provided that the User agrees to fully indemnify and hold harmless Taco Bell from any and all losses, liabilities, claims, expenses, damage awards, including, but not limited to attorneys' fees, indirect, direct, consequential damages of any kind regardless of form, that arise from any claim action, whether in contract, tort, or otherwise, any demand, by use of, or in connection with the transmission, posting, or communication with or to the Site, as well as any interruptions of business, even if Taco Bell has been advised of such damages or such allegedly infringing or otherwise offensive materials contained with the Site.

Users acknowledge and accept that at Taco Bell's sole discretion it may delete, modify, or remove any materials on or from the Site and that Taco Bell, its affiliates companies, employees, directors, officers, agents, material or communication providers, and Internet Service Providers will not be held liable or responsible for any and all losses, liabilities, claims, expenses, damage awards, including, but not limited to attorneys' fees, indirect, direct, consequential damages of any kind regardless of form, that arise from any claim action, whether in contract, tort, or otherwise, any demand, by use of, or in connection with the transmission, posting, or communication with or to the Site, as well as any interruptions of business.

While Taco Bell may remove, delete, or modify materials from the Site at any time, with or without prior notification, it does not monitor any materials posted, transmitted, or communicated to or within the Site. Therefore, Taco Bell may have no knowledge of the material, communication or transmission.

Users and visitors agree that Taco Bell cannot and will not act as arbiter of disputes arising from third party communications or transmission to the Site. At the same time, Taco Bell acknowledges that it may be presented with information that a user's conduct allegedly violates the legal rights of a third party, and as such, may remove, delete, or otherwise modify any material on the Site, or otherwise proceed to handle the alleged violation. Users and visitors acknowledge and agree that the Terms and Conditions do not in any way limit the administrative or legal procedures Taco Bell may undertake when an alleged violation or violation occurs.

Taco Bell may require the complainant to supply a copy of the copyright or trademark registration and/or a copy of the underlying work. In addition, Taco Bell may require the submission of a statement signed under the penalty of perjury, that the underlying or original work, trademark, service mark, or other proprietary property is the property of the complainant (or that the complainant has the authority to make the complaint on behalf of the owner).


CHAT ROOM VIOLATION

If you find a communication in a chat room in violation of the Terms and Conditions, please copy the communication into an e-mail, include the name of the person from whom the communication originated, the date and time of the communication, the name and subject matter of the chat room, and why you believe the communication is in violation of the Terms and Conditions. Upon submission of such information, Taco Bell will review, and, if necessary investigate the matter and take appropriate action, if necessary.

If you do not receive an acknowledgment after submitting your e-mail, you should assume we did not receive it and resubmit it.

I WANT TO REPORT A CHAT ROOM PROBLEM

BULLETIN BOARD POSTING

If you believe that a communication or material posted, transmitted, or located on a bulletin board violates the Terms and Conditions, please copy the communication or material into an e-mail, include the name of the person from whom the communication or material originated, the date and time you first saw the communication or transmission, the name and subject matter of the bulletin board and why you believe the communications or material violates the Terms and Conditions.

If you do not receive an acknowledgment after submitting your e-mail, you should assume we did not receive it and resubmit it.

I WANT TO REPORT A BULLETIN BOARD PROBLEM

OFFENSIVE MATERIAL, COMMUNICATION OR TRANSMISSION

If you find any material, transmission or communication anywhere on the Site offensive or otherwise violates the Terms and Conditions, please copy the communication or material into an e-mail, include the name of the person from whom the material, transmission, or material or communication originated, if available, the date and time you first saw the material or transmission, the name and subject matter of the material, communication or transmission, and why you believe the material, communication or transmission violates the Terms and Conditions.

If you do not receive an acknowledgment after submitting your e-mail, you should assume we did not receive it and resubmit it.

PROBLEMS

If you have any problems with any material, communication or transmission anywhere on the Site, please copy the materials, communication or transmission into an e-mail, include the name of the person from whom the material, communication or transmission originated, if available, and/or the URL where the problem originated, the date and time you first saw the material, communication or transmission, the name and subject matter of the material, communication or transmission and what you believe to be the problem.

If you do not receive an acknowledgment after submitting your e-mail, you should assume we did not receive it and resubmit it.

PROPRIETARY RIGHTS COMPLAINT

If you believe that material, communication posted, transmitted or otherwise located on or within the Site violates proprietary rights, including copyright, trademark, trade secret, right of publicity, or other intellectual property rights, in addition to the information indicated above, please include in your e-mail:

1. A statement that you are either the owner of such alleged rights or an explanation of your relationship, if any, with the owner of such alleged rights, and whether you have the authority to contact Taco Bell on behalf of the owner of such alleged rights. If you are not the owner of such alleged rights, include a statement of how you became aware that such rights allegedly existed;

2. A detailed description of what the material, transmission, or communication allegedly infringes or how it otherwise violates a property or other right;

3. A detailed description of the communication or description, including the exact text or content, the URL or location of where and when you find the text or content;

4. If you believe that someone's copyright rights have been violated, please include the date when the work was first published, if applicable, the date when the work was completed, the date copyright registration was applied for and received, if at all, the registration number, and a description of the work as listed in the registration or application. In addition, indicate whether the work has been assigned or licensed to others, and who, if known, those parties are, and whether the work has been involved in any litigation or other disputes.

5. If you believe that someone's trademark rights have been violated, please include the date the mark was first used in intrastate commerce and interstate commerce, whether the mark is registered with the United States Patent and Trademark Office, with an international registration system, or by a state, the date trademark registration was applied for and received, if at all, the registration number, and the description of goods and services in the registration or application. In addition, indicate whether the mark has been assigned or licensed to others, and who, if known, those parties are, and whether the work has been involved in any litigation or other disputes.

Taco Bell will review and investigate meritorious e-mails and if the activity, posting, submission, transmission, text, graphic, material, or other communication shows a violation of the Terms and Conditions, will undertake appropriate action. If the e-mail does not contain all applicable information indicated above, the claim may be deemed meritless, unless the e-mail includes an explanation of why such information was not included. Once a complaining e-mail is submitted, if the party submitting the claim, or the party's representative, is unwilling to engage in further communications or discussions with Taco Bell and provide Taco Bell with the information and materials necessary to complete its investigation, Taco Bell may deem the claim meritless.
